In September you may have heard that the Duke and Duchess of Cambridge were awarded the sum of £92,000 for compensation over the publication in a magazine for showing photographs of the Duchess sunbathing topless.  The couple were claiming the sum of £1.4 Million.

The Royal couple were claiming for exemplary damages over a ‘grotesque’ breach of privacy when she was photographed with a long telephoto lens in 2012.

What has this got anything to do with a bereavement award where a family have lost a loved one? Well it is simply to illustrate the value the Governments over the years value life of everyone  in England and Wales.

Most people simply cannot believe that the value of a loss of life is valid at £0.00.  Yes NOTHING.

For one moment, we are not saying that the damages award to the Royal Couple are too much or should never have been issued, far from it.  The point, as fatal accident claim solicitors we wish to make is if you compare the distress caused by the publication of topless photographs with the death of a loved one, a child, wife, husband, brother, sister for instance.  It is incomparable.

Yet the law determines the level of compensation.

If a person is killed in England and Wales instantly or dies very shortly afterwards, the value of life is nothing.  However a bereavement award can be payable (but only to a very small number of dependants of the deceased) in the sum of £12,980.  That is it.  Pathetic.

If a child of a parent is unlawfully killed in a car accident, for instance and at the time of death happens to be under 18 years, the parents, between them will share £12,980.  If the child is over 18 years the parents will received no bereavement award.  That is the loss of an adult child is worthless.

Similarly if a parent or parents are killed in a fatal car accident, the child will receieed no bereavement award.  The loss of the child’s parents, once again valued at £NOTHING.

THE LAW IS UNJUST AND NEEDS TO CHANGE.  WHY CAN CELEBRITIES CLAIM SIX FIGURE SUMS FOR ‘HURT FEELINGS AND BREACH OF PRIVACY’ WHEN DEATH TO THE ‘COMMON PEOPLE’ ARE WORTHLESS?
