Case Summary – Fatal Accident Case

Fatal Accident – Lost Years case, involving children, loss of earnings and calculation of compensation, Fatal Accident Act, Coroners Act, Inquest, verdict, fatal accident solicitors, personal injury.

The claimant solicitors in this tragic fatal accident case, made a claim for lost years following injury sustained at birth. At the date of the court hearing, the child was 9 years old. The experts who gave evidence agreed that the child’s life expectancy was to 41 years. The Claimant made a claim for loss of earnings between the age of 41 and 65 years, at £6667 pa (the multiplicand, one third of the agreed net earnings of £20,000) and applying a multiplier of 6.36. On appeal on technical arguments the award was dismissed but there is authority that a claim may be made for this type of loss. Just because a claim for lost years is difficult to claim does not bar a claim for lost years.
