The claimant solicitors in this tragic fatal accident case, made a claim for lost years following injury sustained at birth. At the date of the court hearing, the child was 9 years old. The experts who gave evidence agreed that the child’s life expectancy was to 41 years. The Claimant made a claim for loss of earnings between the age of 41 and 65 years, at £6667 pa (the multiplicand, one third of the agreed net earnings of £20,000) and applying a multiplier of 6.36. On appeal on technical arguments the award was dismissed but there is authority that a claim may be made for this type of loss. Just because a claim for lost years is difficult to claim does not bar a claim for lost years.
