No Win, No Fee Solicitors Guide

Our No Win No Fee Solicitors Commitment

We handle all our fatal accident claims through a No Win, No Fee service, meaning families and dependents don’t have to pay if the claim fails. This agreement ensures that all clients, regardless of their financial background, can access our specialist law firm without risking financial loss, providing complete peace of mind. We can offer this service by taking out specialist ‘after the event’ insurance that covers our legal costs.

As specialist fatal accident solicitors, we can work for free if the case is lost, so you have nothing to worry about by instructing us. A lot of people are concerned about legal costs, but these days, solicitors can now work for free if the claim is lost. Some solicitors do not work on a No Win, No Fee basis, so you should be careful who you obtain advice from.

You, your family and friends are already distressed by the loss of a loved one, but if the deceased was the primary caregiver, the financial worries can be immense. Whether you can afford a specialist solicitor will be the furthest from your mind when instructing our solicitors.

Finding a No Win, No Fee Solicitor

When searching for a No Win, No Fee solicitor, there are several factors to consider. Here’s what our principal solicitor, Ronnie Hutcheon, has to say:

  1. “With us, you have nothing to worry about. Our Warning to you is that if you go elsewhere, there may be hidden costs or work undertaken by non-specialists that can be detrimental to you. There is no risk or worry with us. We will undertake all the paperwork and process your claim quickly, obtaining the maximum amount of fatal accident compensation.”
  2. “We do not ask you to pay upfront charges or sign any credit agreements. If you transfer an existing claim to us, we will either beat or reduce the fee they will charge you when you win the accident compensation claim.*”

Ask Your Solicitor: How Much Do I Pay if I Win?

Before appointing a solicitor, not only should you see if they work under a No Win, No Fee agreement, but you should also confirm how much you will be expected to pay if your claim is successful and you win compensation. Most good fatal accident claim solicitors will work under this policy; however, since a change in the law and legal cutbacks, solicitors often now have to charge their clients a percentage of up to 25% of the compensation recovered.

By instructing us, subject to certain conditions, you can keep 100% of the compensation.

  • £10,000 – 25% (other solicitor fees) = £7,500 left to you
  • £10,000 – 0% (our fees) = £10,000 left to you

That can be a big saving as fatal accident claims are often complex and involve a lot of legal work, which will often result in a quarter deduction.

The Solicitors Regulation Authority

Please remember that solicitors are only registered with the Solicitor Regulation Authority (SRA) and are not regulated by the Ministry of Justice (MOJ). If a company is regulated by the MOJ, it is not a solicitor; however, it may refer your case to a solicitor. By instructing us, you are coming directly to us with no middleman involved. We are proud to have over 27 years of experience, so we are well-equipped to provide advice on complex legal topics.

Free Inquest Hearings Support

We can work for you free of charge, including attending the inquest hearing, if we believe there is a strong case. We can do this if the person at fault was to blame for the death of the deceased in whole or in part and has suitable insurance cover. If death was caused in a road traffic accident by an uninsured or untraced driver, you can still claim under the Motor Insurance Bureau (MIB) scheme.

Thinking of Changing Solicitors?

We have many clients who change solicitors so that we can take over their claim. This happens often, and it is usually a simple process. Please contact us so we can discuss transferring your case to us under our No Win, No Fee, No Worry agreement.

Nothing! With our No Win, No Fee service, we ensure you have specialist legal insurance, which pays for your opponent’s costs if the case fails. We work for free if you lose, subject to qualifying legal expense insurance, which we can obtain on your behalf.

As we are expert fatal accident claim solicitors, if you win your case, the law says that your losing opponent must pay your solicitor's costs. They pay us, not you. If you lose your case, the specialist insurance pays your opponent’s costs. Therefore, as No Win, No Fee solicitors, you pay nothing.

There is no catch! Please see the guide above for more information on how we operate. You can still get 100% of your compensation if you win and pay nothing if you lose or the option of a reduced success fee.

There have been some scare stories in the past about No Win, No Fee solicitors. For example, if a claims company sells a case to a solicitor and the solicitor is required to purchase the specialist legal insurance. The claims company may then be paid a commission for selling the insurance, but the commission payment may not be paid by your opponent. Some solicitors, therefore, may pass that loss on to their clients, which reduces the compensation they receive. There may also be other "hidden charges" which could be deducted from your compensation. The law has recently changed to stop this practice. Rest assured, we are professional solictors, we don't use claims companies, and we don't have any hidden fees.
